We’re your building and construction lawyers in Queensland servicing Brisbane, Sunshine Coast and the Gold Coast. As building and construction lawyers, we practise in our specific area of the law, which is building and construction law. We perform contract work (drafting and reviews) and litigation work (disputes, adjudication) for our building and construction clients. Building projects and the relationships that form because of them are complex. When a dispute arises the complexity of the project and associated relationships requires knowledge and experience. Appointing an appropriately qualified mediator, is essential.
All construction contracts will contain an Alternate Dispute Resolution (ADR) clause, and most will nominate mediation as the prefer method to be used in resolving a dispute. Construction mediation is rapidly gaining popularity as a method of resolving construction disputes, it is fast, cost effective and lets you get on with the
work rather than being tied down in lengthy and costly court proceedings. A dispute can be referred to mediation either via the contract or by the Court.
Either way, there may be no choice other than to participate in mediation to resolve a dispute. Mediation generally works best when both parties to a dispute consent to resolve their differences through the mediation process in the first instance without having to be compelled to do so arbitrarily, although to be adequately prepared for
either option is important; ensuring a party derives greatest benefit out of the process.

accredited mediator. Len commenced his working life as an apprentice carpenter
with the Queensland Public Works Department. In a 20-year building industry career,
Len was a carpenter, builder, estimator, contract administrator and Project Manager.
Len was an expensive experience in both the commercial and residential industries,
working for companies such as Clarendon Homes and Meriton Apartments. He
intimately understands the vast array of disputes that can arise in construction
allowing for greater understanding of the important issues during joint and single-party sessions.

The pre-engagement process starts off with you contacting us to tell us about your legal matter and you asking us whether we may be able to help you. At that stage, we’ll have a conversation to find out enough information for us to estimate whether or not we can help.
If we think we can help you, we’ll send you an engagement pack (containing an engagement letter, disclosure notice and costs agreement) which describes the scope of work we believe you want us to work on, our estimates of costs (depending on our assessment of your matter, some cost estimates may be based on time-based charges and others may be fixed fee) and our terms and conditions of engagement.
If we think we are unable to help you, we will refer you to one or several other law firms for you to consider approaching for help.
